SCLS Website Use Terms of Service

1. Introduction

1.1 By engaging with the Suncoast Community Legal Service (SCLS), you are agreeing to be bound by these Terms of Service (TOS), and agree that you are responsible for compliance with all applicable laws and regulations.

1.2 If you do not agree with any of these TOS, you are prohibited from using our Services including access to our website.

1.3 All SCLS’ content is protected by applicable copyright and trade mark laws.

2. Governing Laws

2.1 Any claim relating to SCLS’ Services shall be governed by the laws of the State of Queensland, Australia.

3. Copyright Content License Grant

3.1 Permission, being a grant of a License, not a transfer of title, is granted to access SCLS’ copyright materials including those made available on our website for personal, non-commercial use by means of non-permanent viewing only. This License automatically terminates if you violate any of our TOS. As soon as the Licence is terminated, you must destroy any content in your possession whether in electronic, printed or any other format.

3.2 Under the above-mentioned License, you may not:

3.2.1 Modify or copy any content.

3.2.2 Use the content for any commercial purpose, or for any public display (commercial or non-commercial).

3.2.3 Attempt to decompile or reverse engineer anything on SCLS’ website.

3.2.4 Remove any copyright or other proprietary notations from any content.

3.2.5 Copy protected content in any way, shape or form including but not limited to taking screen captures of content.

3.2.6 Transfer the content to another person or “mirror” the materials in any way, shape or form.

3.2.7 Share your account details with anyone.

3.3 SCLS’ materials could include grammatical, content, technical, typographical or photographic errors. SCLS does not warrant that any of the materials are accurate, complete, or current. SCLS may make changes to its materials at any time without notice, however, such changes will not affect the terms applicable to interactions which were concluded prior to the date the revisions were published.

3.4 If any part of these Terms of Service is for any reason unenforceable it shall not affect the validity and enforceability of any of the remaining parts of the Terms of Service.

4. Warranties and Limitations

4.1 SCLS’ content is provided “as is” and SCLS makes every reasonable effort ensuring content is accurate.

4.2 SCLS makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4.3 SCLS does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the content on its website or otherwise relating to such content or on any sites linked to our site.

4.4 In no event will SCLS be liable for any damages arising out of the use of, or inability to use, the materials on SCLS’ website, even if SCLS, or an SCLS authorised representative, has been notified orally or in writing of the possibility of such damage.

4.5 Where specific jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply.

5. SCLS Website (Public Access)

5.1 The purpose of SCLS’ website is to communicate and share information about Community Legal Services, including services related to both General Law and Family Law.

5.2 For some of our Services you are required to provide limited personal data (e.g. your email address for our Online Toolkits).

5.3 The purposes for collecting data includes, but is not limited to, counting the number of information services provided to website users via our online Toolkits.

5.4 We only retain personal data as long as necessary for the fulfillment of those purposes, or for other essential purposes such as complying with our legal obligations, resolving disputes and enforcing our agreements.

5.5 When using our website and providing personal information, you confirm that you have the capacity to agree to our Terms of Service and that the agreement is voluntary, informed, specific and current. You may express your views or opinions about how your personal information is handled, or may request to have your personal information permanently deleted by contacting us via our online General Enquiry form.

5.6 We protect personal information by reasonable security safeguards against loss or theft, as well as unauthorised access, disclosure, copying, use or modification.

5.7 The SCLS website uses data encryption technology to encrypt any data that is submitted to us (using SSL) and stored in our secure data centres. We use Google Analytics to gather anonymous visitor information such as visitors’ physical location, referring websites, unique visitors’ number and content popularity. When visiting a page on our website, your browser automatically sends anonymous information to Google. This data we use to analyse site-wide and specific page visits with the aim to improving user experience. You can opt out of Google Analytics tracking.

5.8 SCLS has implemented automated link checking functionality to validate accuracy of all links used on our website, such as our General Law Link Library and Family Law Link Library, but does not guarantee that the link is current or active. SCLS is not responsible for the contents of any such linked site and the inclusion of any link does not imply endorsement by SCLS of the site. Use of any such linked website is at the user’s own risk.

6. SCLS Website (Member Access)

6.1 The SCLS website has a secure section for use by SCLS Staff and Volunteers only.

6.2 Access must be requested using the online “Request Member Access” form. The email address used must be a individual personal email address, not a shared or generic email address. Any requests are manually validated by SCLS.

6.3 Data captured as part of the membership is kept on secure servers and is used only for its intended purpose.

6.4 Members may request to have their membership cancelled and have all their data permanently deleted.

6.5 SCLS may at any time cancel a membership. After a cancellation, the prior member will be notified via email of the removal from the SCLS member group.

6.6 A member must not share membership details with anyone, nor copy or distribute any of the materials available.

7. Terms of Service Modifications

7.1 SCLS may revise these Terms of Service at any time without notice.

7.2 By engaging with SCLS you are agreeing to be bound by the most recent Terms of Service.

7.3 If you disagree with these Terms of Service, have any comments or wish to be no longer bound by these Terms of Service, you can contact us via our online General Enquiry form.
